Terms of Service

1. Acceptance of Terms

By using the Service, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract. You agree to comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

2. Description of Service

Site Haazri provides a cloud-based software service designed for construction contractors in India. The Service allows users ("Contractors") to:

• Manage and track daily attendance, overtime, and work records of their laborers.
• Log financial transactions such as advance payments (peshgi) and other expenses.
• Authorize "Supervisors" with limited access to enter data on their behalf.
• Automatically calculate payroll based on the data provided.
• Generate reports related to attendance and payments.

The Service is provided on an "as-is" and "as-available" basis. We may modify or discontinue the Service at any time without notice.

3. User Accounts

• Account Creation: To use the Service, you must register for an account and provide accurate and complete information.
• Account Responsibility: You are solely responsible for all activities that occur under your account. You must keep your account password confidential and notify us immediately of any unauthorized use of your account.
• Supervisor Accounts: As a Contractor, you may create accounts for your Supervisors. You are responsible for their use of the Service and for ensuring they comply with these Terms.
• Data Accuracy: You are responsible for the accuracy, legality, and quality of all data you or your Supervisors enter into the Service. Site Haazri is a tool for calculation and record-keeping; we are not responsible for verifying the accuracy of the data you provide.

4. Subscriptions & Payment

Site Haazri offers different subscription plans:

• Basic Plan (Free): This plan is offered free of charge and may have limitations on features, such as the number of laborers, number of sites, or the duration of data history available. We reserve the right to change the features and limitations of the Basic Plan at any time.
• Pro Plan (Paid): This plan provides access to premium features for a recurring fee.

Payment Terms:

• Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis ("Billing Cycle").
• Auto-Renewal: At the end of each Billing Cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your subscription renewal through your account settings on the Google Play Store.
• Payment: A valid payment method is required to process the payment for your subscription. By submitting such payment information, you automatically authorize us to charge all subscription fees incurred through your account to any such payment instruments.

Promotional Offers:

• Introductory Offers: We may, at our sole discretion, offer a subscription with a free trial or a promotional introductory price (e.g., "First month for ₹1").
• ₹1 Offer: If you subscribe to such an offer, you will be charged the promotional amount for the first month. At the end of the promotional period, your subscription will automatically renew at the regular, full price of the Pro Plan unless cancelled.
• Fee Changes: We reserve the right to modify the subscription fees at any time. Any fee change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change in subscription fees to give you an opportunity to terminate your subscription before such change becomes effective.

5. User-Generated Content

• Ownership: You retain full ownership of all the data you and your Supervisors input into the Service, including laborer information, attendance records, and financial data ("User Content").
• License to Us: By using the Service, you grant Site Haazri a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and create derivative works (such as those resulting from translations, adaptations, or other changes we make so that your content works better with our Service) of your User Content. This license is for the limited purpose of operating, providing, and improving the Service. This license continues even if you stop using our Service, as we may need to retain data for backup and legal purposes.

6. Termination

• Termination by You: You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Service will immediately cease.
• Termination by Us: We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
• Effect of Termination: Upon termination, all data associated with your account may be deleted, except as required by law. We are not liable for any loss of data resulting from account termination.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Site Haazri, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Our total liability to you for any and all claims arising out of your use of the Service is limited to the amount you paid us, if any, in the 12 months preceding the claim.

8. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms will be brought exclusively in the competent courts of Gautam Budh Nagar, Uttar Pradesh, India.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
